Statement of Non-Discrimination
El Poder de Ser Mujer’s Statement of Nondiscrimination is posted herein. It reads as follows: El Poder de Ser Mujer operates in accordance with nondiscriminatory requirements including, but not limited to, the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, the Age Discrimination Act of 1975, the Americans with Disabilities Act of 1990, and any amendments to these Acts. No individual shall, on the grounds of race, color, national origin, disability, age, gender (including gender identity), sexual orientation, religion, or any other legally protected classification, be excluded from participating in, be denied benefits of, or be otherwise subjected to discrimination under any program, service, or benefit provided by El Poder de Ser Mujer. The following grievance procedure is to be used in the event of a discrimination complaint.
Employee Responsibilities
It is the responsibility of all El Poder de Ser Mujer employees to assist complainants in the resolution of a discrimination complaint. In the event that an employee is notified of such a complaint, they should immediately contact the Director.
Grievance Procedure
This grievance procedure may be used by anyone who wishes to file a complaint of any kind in the provisions of services, activities, programs, or benefits by El Poder de Ser Mujer Inc.
Submitting a Complaint
The complaint should be in writing and contain information about the alleged discrimination such as name, address, phone number of complainant and location, date, and description of the problem. Alternative means of filing complaints, such as personal interviews or a tape recording of the complaint, will be made available for persons with disabilities upon request.
The complaint should be submitted by the grievant and /or his/her designee as soon as possible but no later than 60 calendar days after the alleged violation to: elpoderdesermujer0.com. Within 15 calendar days after receipt of the complaint, a representative of El Poder de Ser Mujer Inc. will meet with the complainant to discuss the complaint and the possible resolution. Within 15 calendar days of the meeting, a representative of El Poder de Ser Mujer will respond in writing, and where appropriate, in a format accessible to the complainant, such as large print, braille, or audio tape. The response will explain the position of El Poder de Ser Mujer Inc. and offer options for substantive resolution of the complaint.
Responding to Complaints
If the response by the representative of El Poder de Ser Mujer Inc. does not satisfactorily resolve the issue, the complainant, or his/her designee, may appeal the decision within 15 calendar days after receipt of the response to Sagrario Ortiz, Director , El Poder de Ser Mujer.
Within 15 calendar days after receipt of the appeal, a representative of El Poder de Ser Mujer Inc. will meet with the complainant to discuss the complaint and possible resolutions. Within 15 calendar days after the meeting, a representative of El Poder de Ser Mujer Inc. will respond in writing, and, where appropriate, in a format accessible to the complainant, with a final resolution of the complaint.
All written complaints received by El Poder de Ser Mujer Inc., and all appeals to its responses, and all responses from El Poder de Ser Mujer Inc. will be retained by the organization for at least three years.
Prohibition of Coercion, Reprisal, or Intimidation
Coercion, reprisal or intimidation against any person filing a complaint, either internally or through an outside enforcement agency or other legal channels, or against any person serving as a witness in relation to the complaint, is strictly prohibited.
